French Closer mag banned: no more topless Kate pics

The French version of the magazine Closer has been banned from publishing online or in print, any more of those topless pictures of the Duchess of Cambridge. Lawyers representing her and her husband, Prince William, were successful in arguing a civil case, they sought around £4,000 in damages and asked for the original images to be handed over to them. Difficulty is of course the magazine doesn't own the original photos. The man who took them is believed to be in hiding. Catherine Middleton was photographed sunbathing on a balcony while on holiday with the Duke. The shots were taken with a telephoto lens from the road, a kilometre away from the terrace of the chateau where they were staying. Crowds flocked to see the young royals leaving the Solomon Islands to Tuvalu, on what will be their last day of a South East Asian Queen's Diamond Jubilee tour. The couple have been doing their best to ignore the intense media scrutiny since the photos were released. Those representing French Closer magazine in court defended the publication, saying photos like this don't shock people anymore. If the magazine owners decide to ignore the injunction, they will be fined around £8,000 for every day they refuse to surrender all their copies of the images of Catherine. They also have to pay the royal couple around £1,600 in legal fees. Although French Closer won't be allowed to republish the images, it stills leave the matter of the 50 page special in its Italian sister magazine, Chi, and the fact that the pictures are now widely available for free online. A criminal inquiry has also been started today to find out whether, under French law, the Royal couple's right to privacy has been breached.

The Duke and Duchess of Cambridge have launched legal action against the French magazine Closer over its publication of topless pictures of the duchess, Clarence House has said. The celebrity gossip magazine printed pictures of the duchess taken during the couple's private holiday in France. A royal spokesman said the legal proceedings had been launched in France and were for breach of privacy. Closer's editor says the couple were "visible from the street". "These photos are not in the least shocking. They show a young woman sunbathing topless, like the millions of women you see on beaches," said Laurence Pieau. She described the reaction as "a little disproportionate". The magazine's website says the pictures are of the couple "like you have never seen them before. Gone are the fixed smiles and the demure dresses. On holiday Kate forgets everything." French publication Closer printed the pictures of the duchess A royal spokesman said: "St James's Palace confirms that legal proceedings for breach of privacy have been commenced today in France by the Duke and Duchess of Cambridge against the publishers of Closer Magazine France." The BBC's Nicholas Witchell said he had rarely seen such a level of publicly expressed anger over such an incident, and this anger reflected William's feelings on the matter. Our correspondent said that the prince had a "look of absolute thunder" on his face as they left Kuala Lumpur - a stop on their nine-day tour of South East Asia - to travel to Sabah in north Borneo. Kate, meanwhile, "looked composed and was smiling", he said. The duke and duchess, who were staying at the French chateau of the Queen's nephew, Lord Linley, "have been hugely saddened to learn that a French publication and a photographer have invaded their privacy in such a grotesque and totally unjustifiable manner", a spokesman for Clarence House, the Prince of Wales's office, said earlier. British newspapers were offered photographs last week but turned them down. The Sun - the only British publication to publish recent pictures of Prince Harry naked - said it had no intention of publishing the images. "The circumstances are very different to those relating to the photos of Prince Harry in Las Vegas. As we said at the time, he was at a party in a hotel suite with a large group of strangers and one of those present released a photograph into the public domain," said the Sun's editor Dominic Mohan.

The editor of the French magazine Closer - which on Friday claimed that Francois Hollande was having a secret affair with an actress - responds after the French President threatened legal action over the allegations. President François Hollande was facing a private and political crisis after a celebrity magazine published photos it says proves he is having a "secret love affair" with a film actress almost 20 years his junior. Closer magazine released photos it says shows the 59-year old Socialist leader and his new lover, Julie Gayet, 41, entering an apartment block a stone's throw from the Elysée Palace in Paris. Closer magazine published images showing a bodyguard and a helmeted man it claimed is Hollande visiting the apartment of Julie Gayet, 41, a moderately known French actress who appeared in a clip for his 2012 presidential campaign. French media faces strict privacy laws, as well as a longtime tradition of ignoring the private lives of public figures. Asked by French radio station RTL whether her magazine had infringe President Hollande's privacy, Closer editor Laurence Pieau replied: "In a very relative way." Referring to the rumoured affair, she argued that "many people already know about it today in Paris." "A lot of political journalists also knew about it, and any journalist in Paris knew about it," Ms Pieau said. "So the rumour has circulated." President Hollande said in a statement he "deeply deplores the attacks on respect for privacy, to which each citizen has a right." He is weighing possible action, including via the courts, it said. He did not address the alleged affair. Ms Pieau acknowledged that Hollande might sue 'Closer' magazine, citing his right to a "private life", according to the French civil code - which she called "the most restrictive in the world in terms of private life". She also said the president might sue the magazine on the basis of the "legal right to one's image". But, she argued, it would mark the first time that a French president sued a magazine for violation of his right to privacy. Laurence Pieau, editor of Closer, announced it was withdrawing the photos from its website upon request from Miss Gayet's lawyer. "If there are any legal procedures, regarding (Miss Gayet) it will be for image rights and violation of privacy, but not defamation," said Mis Pieau. However, she insisted the withdrawal "in no way casts into doubt the veracity of the information divulged today". Closer had received no request to remove the magazine from newsagents, she said, adding that Mr Hollande was simply a "president who has a crush". Lawyers representing the Duke and Duchess of Cambridge are expected to appear in a court in Paris today to face the editor of Closer, the French magazine, which published topless photos of Catherine. They'll be arguing a criminal case for the breach of the Royals' privacy and they will be seeking a ban on the sale of the magazine, which has sparked worldwide controversy, ever since the Italian version of Closer first bought the pictures and the French one followed suit. Laurence Pieau, Editor-in-Chief, argued that the lack of security - which allowed the photos to be taken in the first place - is the bigger issue, rather than an invasion of privacy. As for legal action against the publication, she said: 'We'll see what happens', adding that she didn't publish the most degrading pictures, only those which showed 'a wonderful couple in love'. "We decided to publish these pictures in the French Closer because we thought these pictures are not shocking. For us, these pictures are the picture of a wonderful couple which is in love and nothing else." News of the photos dominated the British weekend headlines with many people astonished that any publication would want to profit from such tasteless photos. The editors' actions have echoes of the constant and over the top media intrusion that Prince William's mother, Diana, faced. The Duke and Duchess of Cambridge have already said they are 'very angered' in that regard. Meanwhile there's more fallout on this side of the Channel regarding the controversial pictures. The co-owner of The Irish Daily Star, Richard Desmond (who also owns The Express and the Daily Star newspapers in England), is said to be 'furious' and will cut ties with the title and is taking steps to have it shut down. The Duke and Duchess meanwhile are still enjoying their 9-day long public Diamond Jubilee engagement in South East Asia, which is coming to an end. They gave away nothing of their feelings of anger or frustration over the current situation. The court also ordered the defendants to pay damages to Kate and her husband Prince William, but the amount was significantly lower than that sought by the royal family. Kensington Palace said Tuesday that the Duke and Duchess of Cambridge are pleased with the ruling and consider the matter now closed. The court in a Paris suburb ruled that three photographers and three newspaper executives invaded the privacy of the duchess by taking and publishing the photos. Two executives of French gossip magazine Closer were each given the maximum 45,000 euros (53,500 US dollars) fine for such an offense. In addition, the two executives, along with two photographers working with a celebrity photo agency, were collectively ordered to pay 50,000 euros (59,500 US dollars) in damages to Kate and the same amount to William. The amount is far below the about 1.5 million euros in damages sought by the royal couple. Lawyer Christopher Mesnooh said the court awarded the damages in line with the French legal system. The couple, who didn't attend the verdict, had filed a complaint after the photos were published in Closer and a regional newspaper in 2012, the year after their wedding. This time it is The Duchess of Cambridge's turn, as topless pictures of her on holiday, have been published by the French magazine closer. The pictures were taken during the Duke and Duchess' holiday at the French chateau of the Queen's nephew, Lord Linley. And although the photos are blurry and taken with a long lens, they are clearly of the Royal couple. Kate can be seen topless in several shots, and it is these shots which have been used as part of the magazines four page spread. Prince William and Kate who are on an official visit to Asia as part of the Queens Diamond Jubilee Tour were told about the magazine's plan to publish the photos during breakfast in Kuala Lumpur. With the publication of these photos and the naked shots of Prince Harry just last month . It is the first country visited by the couple during their tour where the Queen is head of state. Back home, a St James' Palace spokesman described a decision by the Irish Daily Star to publish the topless photographs as motivated "by greed". The royals' condemnation came as the future of the Irish newspaper became uncertain after its co-owner, Northern and Shell, which prints the Star and Express titles in the UK, said it would end its joint venture with the Dublin tabloid in protest at the publication.

A French court on Tuesday fined photographers and gossip magazine executives over topless photos of the Duchess of Cambridge. The court also ordered the defendants to pay damages to the duchess and her husband Prince William, but the amount was significantly lower than that sought by the royal family. The court in a Paris suburb ruled Tuesday that three photographers and three newspaper executives invaded the privacy of the duchess, formerly known as Kate Middleton, by taking and publishing the photos. Two executives of French gossip magazine Closer were each given the maximum 45,000 euro ($53,500) fine for such an offense. In addition, the two executives, along with two photographers working with a celebrity photo agency, were collectively ordered to pay 50,000 euros ($59,500) in damages to Kate and the same amount to William.

The weekly magazine last month published a seven page photo spread of activity outside a Parisian apartment block to support its allegation. The pictures showed the arrival of one man resembling one of Hollande's bodyguards, a second man - which it purported was Hollande - arriving and leaving on a scooter, unidentifiable in a black helmet. A woman, who the publication alleged was Gayet, was also seen arriving at and leaving the same apartment. "It's a breach of privacy, to follow people and track them, to have a contract by which a paparazzi follows someone for weeks, from their house, everywhere. There is breach of privacy for legitimate reasons," Gayet's lawyer, Jean Enocchi, told reporters after a court hearing in Nanterre, near Paris. Gayet is seeking 50,000 euros in damages and 4,000 euros in legal costs. Lawyer representing Closer magazine, Delphine Pando, said she didn't feel the case would get any more priority than a regular case, just because it involved the French President. "But I think your particularly imposing presence today shows that this is not an ordinary case," she told reporters outside the courtroom. The court will hand down its ruling on March 27. Those publishers who printed topless pics of Kate Middleton are in a whole lot of hot water. In 2012, a group of paparazzi and media execs thought they hit the jackpot when they snapped and published some topless photos of Kate Middleton in France. Turns out they didn't, and this week they learned they will head to trial for invasion of privacy, according to The Sun. Various outlets and a photographer are under investigation for printing the grainy photos of Middleton on a private balcony while on holiday in the south of France with Prince William, but Closer magazine and it's publisher Mondadori are bearing the brunt of the legal action for being the originators of the photos. If convicted, Closer could be shut down for a good chunk of time. "The photographer and legal representatives of both companies have been questioned concerning the photographing of a person on private property and the criminal use of these images," a spokesperson for the prosecutor of the case said in 2013, via The Sun. "The maximum penalty for this kind of offense is one year in prison and a fine of 45,000 euros (£38,350) for individuals... For corporate bodies, the fine is 45,000 euros, cessation of business for five years and public notification of the decision." [That's about $46,500 USD.] As it turns out, French authorities aren't going after Closer for taking the nearly nude photos of the Duchess of Cambridge, but they're going after them for taking the pictures of anybody, period. The paparazzi would have violated laws by invading the privacy of any of us. The difference is, photos of a plebeian wouldn't be splashed all over newspapers and the internet.

Rumours have long circulated that Hollande might have a lover. The magazine Closer published images January 10th showing a bodyguard and a helmeted man it says is Hollande visiting the apartment of Julie Gayet, a moderately known French actress who appeared in a clip for his 2012 presidential campaign. French media faces strict privacy laws, as well as a longtime tradition of ignoring the private lives of public figures. Former President Francois Mitterrand had a daughter with his lover that the French media knew about but never revealed, until the president himself appeared publicly with his daughter coming out of a restaurant. But the publication marked the latest incursion into the once-sacred private lives of French politicians. The tradition of keeping private lives private has been chipped away since Hollande's predecessor Nicolas Sarkozy divorced his wife Cecilia, who was having an affair, and married model and singer Carla Bruni. Bloggers, tweeters and other online sources have tapped into public curiosity and pushed the boundaries of French privacy. Closer last made a splash when it published topless photos of British Prince William's wife, Kate. Hollande said in a statement he "deeply deplores the attacks on respect for privacy, to which each citizen has a right." He is considering possible action, including via the courts, it said. He did not address the alleged affair. Hollande, who was dubbed "Monsieur Normal" by French media, has never married. He has four children with politician Segolene Royal, and has been living in recent years with his partner, journalist Valerie Trierweiler, considered France's first lady. Gayet's lawyer and agent did not immediately return phone and email messages on Friday about the Closer report. Closer published images it says show one of Hollande's bodyguards at the door to Gayet's building, and a motorcyclist arriving to drop off a helmeted man on the night of December 30 and escorting him away the next morning. The magazine, a tabloid known for suggestive photos and gossip, says the alleged affair raises questions about the president's security, if he is sneaking out with a single bodyguard and travelling exposed on the back of a motorcycle. Hollande's popularity is very low, largely over voter frustration at his failure to reduce unemployment and get the economy growing. A French court has ruled that privacy was indeed breached and shared the ruling just after the announcement regarding Kate and William’s pregnancy news. Unfortunately, the event is said to have brought terrible memories to the forefront for Prince William, seeing as it was believed that his late mother, Princess Diana, was being pursued by French paparazzi and members of the French press when she died tragically in a car accident in Paris, back in 1997.

She entered hospital on Friday "for rest and some tests", her office said, after Closer magazine published images linking him to actress Julie Gayet. Mr Hollande did not deny the report but protested at invasion of his privacy. Conservative opposition leader Jean-Francois Cope has suggested the drama has damaged France's image abroad. 'Unpopular' Hollande. Ms Trierweiler is expected to leave hospital on Monday, her office told AFP news agency. Political commentators have called on Mr Hollande to clarify her role as first lady. The French press has also been asking questions about the flat, just round the corner from the Elysee Palace, where the pair apparently met. It has been reported that it was borrowed by Ms Gayet from a friend, another actress, with links to the Corsican mafia. A presidential news conference scheduled for Tuesday on plans to boost the flagging economy now looks like being overshadowed by Mr Hollande's private life, correspondents say. Opinion polls already suggest he is the most unpopular president in a generation - one on Thursday indicated that only 25% of French people trusted him. The French media face strict privacy laws but the tradition of secrecy over the private lives of public figures has been steadily eroded in recent years. However, opinion polls suggest the French public appears to be averse to reporting politicians' private lives. According to an Ifop-JDD poll published on Sunday, three out of four French people believe the alleged affair is a private matter for the president. But with this dramatic twist affecting his official partner, it is increasingly hard to argue that these are personal matters which should not be under public scrutiny, says the BBC's Hugh Schofield in Paris. Privacy Debate. On Friday, Closer magazine printed a seven-page article about the alleged affair between Mr Hollande and Ms Gayet. It was illustrated with photos showing a man said to be the president visiting a flat near the Elysee Palace at the same time as Ms Gayet. The man said to be the president is wearing a helmet and is ferried to and from the building on a moped. Mr Hollande threatened to sue over the report, which he called an "attack on the right to privacy", without denying the allegation. Allegations of the affair are not new. Ms Gayet lodged a complaint in March last year after a report of the liaison appeared online. In December, another actor, Stephane Guillon, teased her over Mr Hollande during a talk show to promote a new film. The same month, L'Express magazine reported mounting concern among presidential staff over the president's frequent "escapades", without giving details. Ms Trierweiler, who is a divorcee and mother of three children from an earlier marriage, is Mr Hollande's official partner and lives in a wing of the Elysee Palace. Mr Hollande, who has never married, left his previous partner and mother of his own four children - fellow Socialist politician Segolene Royal - to be with her. Mr Cope, leader of the centre-right UMP, said that while he was "very attached to respect for privacy", this recent incident was a "lesson in humility" for Mr Hollande.
